• No purchase necessary. Void where prohibited by law. Entrants residing in areas where the contest is void are ineligible to win prizes.
• To enter the Contest, you must:
  1. Fully complete the Entry Form on-line at www.niagarasfury.com from 12:01pm on June 14, 2008 to 11:59am on August 29, 2008 (eastern standard time). To qualify for the Grand Prize draw the entry ballot must be filled out in its entirety, including name, e-mail address, mailing address and phone number. A valid e-mail address must be provided.
  2. Correctly answer, unaided, the following skill-testing question:

  4. Only one entry per person. Participants making multiple entries will be disqualified. Entries that are fraudulent are not permitted and will be declared invalid. All entries that are incomplete, submitted through illicit means or do not conform to or satisfy any condition of the Contest Rules will be declared invalid. All entries become the property of Niagara Parks and will not be acknowledged.
• A random draw, conducted by the Niagara Parks Commission, from all eligible entries received as of the Contest Closing Date will be made on September 4, 2008 at approx. 3:30pm (eastern standard time) in Niagara Falls, Ontario. Odds of winning depend on the number of eligible entries received. Before being declared a winner, selected entrant's answer to the skill-testing question included on their On-Line Entry Form will be verified and must be determined to be correct by the Niagara Parks Commission. On-Line Entry Forms containing incorrect answers to the skill-testing question will be ineligible to win any prize in this Contest. Selected entries will be contacted by telephone at the telephone number indicated on their On-Line Entry Form within three (3) business days.
• If a selected entrant cannot be reached personally, without leaving a message, within seven (7) business days of the first phone call made and after a minimum of three call attempts by the Contest Administrator or if the entrant declines the prize, or does not otherwise comply with these Contest Rules ("Rules"), another random draw or draws will be conducted to select replacement entrants in the same manner.
• If the identity of an on-line entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this contest will be the Contest server machine(s).
• There will be One (1) Grand Prize awarded consisting of One, Two(2) night stay at a Niagara Falls Hotel, Passes for Niagara Parks Attractions, Lunch for Four(4) at a Niagara Parks Restaurant, Dinner for Four (4) at a Niagara Parks Restaurant. Gratuities, other entertainment, merchandise, souvenirs, local and long distance telephone calls, medical, taxes, travel and cancellation insurance and all personal expenses of any kind are not included and are the sole responsibility of the Grand Prize winners and their travel partners. Prize must be taken prior to June 30, 2009, and will not be rescheduled or substituted once booked. No responsibility is assumed by the Released Parties for canceled, delayed, suspended or re-scheduled events or travel after ticketing for any reason whatsoever beyond its control. Transportation and accommodations are subject to availability, blackout periods, governmental restrictions and regulations. Other restrictions may apply. The Grand Prize winners and their travel partners must be available to travel on the dates arranged by the Contest Sponsor. The odds of being selected are dependent on the total number of eligible entries received by the cut-off date and time for each prize.
• The Contest Sponsor makes no representation or warranties in respect of the prizes and accepts no liability arising in respect of such prizes. All prizes must be accepted as awarded and may not be transferred (other than as allowed for herein), or exchanged and have no cash surrender value. Contest Sponsor reserves the right to substitute a prize of equal or greater value in the event of the unavailability, for whatever reason, of the advertised prizes.
• Winners must also return a signed Declaration and Release of liability and publicity within a specified period of time, before being entitled to a prize, failing which the prize will be forfeited. The winners of the Grand Prize must also arrange for the signature and return of a Declaration and Release by the winner's travel partner before being entitled to a prize. If the Grand Prize winner's travel partner is a minor, such person must have consent from their parent or legal guardian who must sign the Declaration and Release on their behalf. Decisions by the Niagara Parks Commission are final and without appeal in all matters related to this Contest and the awarding of prizes.
• By entering this Contest, each entrant consents to the use of his/her entry, name, address and/or photograph in any publicity carried out by the Released Parties and/or their advertising agencies, without further compensation. All entries become the property of the Consent Sponsor and will not be returned.
• By entering the Contest, participants consent to Niagara Parks' collection, use and disclosure of the personal information provided in Contest entries for the administration of the Contest and in aggregated, non-personal form in order to create reports regarding Contest entrant demographics and consumer habits.
• This Contest is open to those who are over the age of Eighteen (18), excluding employees of the Released Parties and their respective affiliated companies, agents, advertising and promotional agencies, prize suppliers and Contest judges, and all those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
• No communications will be entered into except with the selected entrants who will be notified by telephone.
• The Contest Sponsor, the Contest organizers and their respective parents, subsidiaries and affiliates, the suppliers of prizes or services related to the Contest, and their respective advertising, promotion and production agencies and other agents or representatives will not, under any circumstances, be responsible for, or liable to any Contest entrant or any other person for:
  1. any erroneous, lost damaged, late incomplete, misdirected, deleted, defective, or altered Contest entries, regardless of cause;
  2. any failure for any reason whatsoever of the selected entrant to receive a prize notification email;
  3. any changes in e-mail addresses or e-mail address assignments after Conteset entry forms are submitted;
  4. any computer, online, telephone, technical malfunctions or errors that may occur, regardless of the cause; or
  5. any damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of market, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Contest or the submission of entries to the Contest or participation in the Contest or the Contest prize, or the use of the niagarasfury.com web site (including the downloading of any materials from that web site) and regardless of the cause or any negligence by the Contest Sponsor or anyone for whom the Contest Sponsor is responsible, and notwithstanding that the Contest Sponsor may have been advised of the possibility of such loss or damage being incurred.
  The Released Parties assumes no responsibility for lost, stolen, delayed, damaged, illegible or misdirected entries or entries that have been submitted through illicit means, or do not conform to or satisfy the Rules or for failure of the web site during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or traffic congestion on the internet or any web site, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. The Contest Sponsor reserves the right, in its sole discretion, to cancel or suspend the e-mail portion of this Contest should a virus, bug or other cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Released Parties reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest.
• Winner and travel companion (s), by acceptance of their prizes, agree to release the Contest Sponsor, the Released Parties, the Contest organizers and their respective parents, subsidiaries and affiliates, the suppliers of prizes or services related to the Contest, and their respective advertising, promotion and production and production agencies and other agents or representatives from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in and/or traveling to any prize-related activity.
• Decisions of Contest judges in respect of any aspect of the Contest are final and binding on all entrants.
• Participation in the Contest constitutes acceptance and agreement to these Contest Rules, as may be amended by the Contest Sponsor.
• The Contest is subject to all applicable federal, provincial and local laws and is void where prohibited by law. If any provisions of these Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.

The Niagara Parks Commission (NPC) ensures that any personal information collected from customers is collected, used, disclosed and eventually destroyed in a manner that is secure and responsible. We believe that the measures we have developed and implemented will serve that interest and maximize your experience with us.

Collection of Information

Personal information is any information about an identifiable individual. This includes information such as your name, address, e-mail address and any payment information you provide. All personal information that we collect is provided voluntarily when you choose to contact us or to purchase merchandise and/or services. We collect only the information that is required to provide the services you requested. NPC will not retain personal information for longer than is reasonably necessary or applicable law permits.

Any statistical reporting that is created or disseminated is on a completely anonymous basis. In other words, it would not be possible to ascertain the individual to whom the information relates.

Disclosure of Personal Information

NPC will not provide your personal information to third parties unless the disclosure of that information is:
(a) required by law;
(b) made in response to your request for the services we provide; or,
(c) made with your express consent.

In the event that it is necessary to provide personal information to one of the business partners with whom we contract to provide those services, those partners have contractually agreed to adhere to the privacy provisions under which we operate.

NPC has procedures in place to secure all personal information in our possession. Access to your personal information is limited to those staff members and business partners who require it in order to fulfill your requests. Additionally, we maintain a secure server and an up-to-date security system to safeguard your transactions and the information you provide.

Accessing Personal Information

Should you wish to view, delete or change your personal information please advise us at npinfo@niagaraparks.com. In an effort to ensure that the information you have provided is accurate, up-to-date and retained only as long as required, the information is destroyed within a specified period following your last purchase and/or correspondence.
